What’s covered in these terms

These Terms of Service (“Agreement”) are entered into between the customer (“Client”) and SOFTRE INDIA BUSINESS SOLUTIONS PRIVATE LIMITED, trading under the name SOFTRE (“Service Provider”), for the provision of trademark services in India. By engaging the Service Provider’s services, the Client agrees to be bound by the terms and conditions set forth in this Agreement.

  1. Service Description:

The Service Provider offers trademark services to assist the Client in the trademark registration process. These services may include but are not limited to trademark search, application filing, document preparation, consultation, and representation before the concerned authorities.

2. Service Fees:

  1. The Client agrees to pay a consulting fee of INR 499 (Indian Rupees four hundred ninety-nine) as a non-refundable advance towards the professional fee.
  2. The professional fee charged by the Service Provider will be further discounted in the final bill.
  3. In addition to the professional fee, the Client is responsible for paying the government fees associated with trademark registration. The government fee per application/class is INR 4500 (Indian Rupees four thousand five hundred) for individuals and MSMEs, and INR 9000 (Indian Rupees nine thousand) for companies.

 

Please note that the discount is limited to a limited number of clients booked through our online campaigns. SOFTRE reserves the right to determine the availability and eligibility of clients for the discount. The specific terms and conditions for the discount will be communicated to the eligible clients at the time of engagement.

3. Engagement and Payment:

  1. The Client can engage the Service Provider by initiating contact through the provided channels, such as phone, email, or online inquiry form.
  2. Once the Client expresses their intention to avail trademark services, the Service Provider will confirm the engagement and provide payment instructions.
  3. The consulting fee of INR 499 shall be paid in advance by the Client to initiate the service.
  4. The Client acknowledges that the professional fee and government fees are separate from the consulting fee and will be invoiced separately.
  5. The Service Provider reserves the right to revise the professional fee and government fees at any time. However, such revisions will not affect ongoing engagements and will be applicable to new engagements only.

4. Service Provision:

  1. The Service Provider will commence the trademark services upon receipt of the consulting fee, power of attorney, and any additional required documents or information from the Client.
  2. The guaranteed 2-hour filing timeline is applicable only after receiving the power of attorney and when the invoice payment has been fully cleared.
  3. The Client acknowledges that any delays in providing the required documents or clearing the invoice payment may extend the filing timeline beyond the guaranteed 2-hour period.
  4. The Service Provider will make all reasonable efforts to complete the filing process within the specified timeline but does not guarantee the acceptance or approval of the trademark application within that time frame.

 

Please note that the guaranteed 2-hour filing timeline is dependent on the Client promptly submitting the required documents and ensuring timely payment clearance.

5. Client Responsibilities:

  1. The Client agrees to provide accurate and complete information and documents required for the trademark registration process.
  2. The Client acknowledges that any delays or errors caused by inaccurate or incomplete information provided by the Client may affect the service timeline and outcome.
  3. The Client is responsible for complying with all applicable laws, regulations, and guidelines related to the trademark registration process.

6. Confidentiality:

  1. The Service Provider agrees to maintain the confidentiality of all information provided by the Client during the course of the engagement, except as required by law.
  2. The Client acknowledges that certain information, such as the trademark application itself, may become publicly available during the registration process and releases the Service Provider from any liability regarding such disclosures.

7. Limitation of Liability:

  1. The Service Provider shall not be liable for any damages, losses, or expenses incurred by the Client arising from the trademark registration process or any related activities.
  2. The Client acknowledges that the Service Provider’s liability is limited to the extent permitted by law.

8. Governing Law and Jurisdiction:

  1. This Agreement shall be governed by and construed in accordance with the laws of India under the jurisdiction Tumakuru, India.
  2. Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts located within the territorial limits Tumakuru, India

9. Entire Agreement:

This Agreement constitutes the entire understanding between the Client and the Service Provider regarding the trademark services and supersedes any prior agreements or understandings, whether written or oral.

By engaging the Service Provider’s trademark services, the Client confirms their acceptance of these Terms of Service.
